Nude Food Movement Terms and Conditions

HOW TO PARTICIPATE

In order to participate, individuals must visit www.nudefoodmovement.com.au, follow the prompts to the multiple choice quiz page, answer five (5) multiple choice or true/false questions correctly, input the requested details, nominate a participating secondary school or primary school from the drop-down box provided to allocate five (5) points.

Private schools in New South Wales are not eligible to participate in this promotion and cannot be nominated to receive points.

In the event that a participant wishes to nominate a school that is not listed in the drop down box provided (excluding a private school in New South Wales), the participant must enter the school name in the designated field (in order to notify Vibe Village via the Nude Food Movement website) and Vibe Village will advise whether the participant will be permitted to allocate points to that particular school.

TERMS AND CONDITIONS

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents.
  3. Employees (and their immediate families) of the Promoter, Vibe Village and agencies associated with this promotion are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. The Promoter and Vibe Village reserve the right, at any time, to verify the validity of entries and participants (including a participant's identity, age and place of residence) and any points allocated to a participating school and to disqualify any participant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry, points allocation/counting or donation process. Errors and omissions may be accepted at the Promoter's and/or Vibe Village's discretion. Failure by the Promoter and/or Vibe Village to enforce any of their rights at any stage does not constitute a waiver of those rights.
  5. Incomplete, indecipherable or illegible entries will be deemed invalid. Participants must get five (5) multiple choice or true/false questions correct in order for the chosen school to earn five (5) points and in order for $1 to be donated to The Smith Family.
  6. Only one entry permitted per person (i.e. individuals can only nominate a school to receive 5 points and have their entry count towards the donation total once), however participants can answer the promotional questions as many times as they like.
  7. If there is a dispute as to the identity of a participant or winning nominated school, the Promoter and/or Vibe Village reserve the right, in their sole discretion, to determine the identity of the participant or winning nominated school.
  8. Promotion commences on 28th September, 2009 and ends at 11:59pm AEDST on 1st December, 2009.
  9. For each participant that logs onto the promotional website and correctly answers five (5) multiple choice or true/false questions during the promotional period, the Promoter will donate $1 to The Smith Family Healthy Eating Programs, up to a maximum donation of $10,000.
  10. In the event that a participant logs onto the promotional website to complete the multiple choice quiz and the maximum donation amount of $10,000 has already been reached, the participant will still be able to nominate a participating school to receive points; however, no further donation will be made to The Smith Family's Healthy Eating Programs.
  11. Each participant will also be required to nominate a participating secondary school or primary school to allocate five (5) points to (excluding private schools in New South Wales). At the end of the promotional period, the ten (10) participating schools with the highest number of points, as determined by the Promoter and Vibe Village in their absolute discretion, will receive a $1,000 Smash gift voucher to spend on sporting equipment for the school ("Gift Voucher"). The Gift Voucher must be redeemed by 31st June, 2010.
  12. Any ancillary costs associated with redeeming the Gift Voucher are not included. Any freight or postage charges are the responsibility of the winning schools and will not be paid by the Promoter. The Promoter reserves the right to charge freight charges and/or postage charges if deemed necessary. Any unused balance of the Gift Voucher will not be awarded as cash. Redemption of the Gift Voucher is subject to any terms and conditions of the issuer including those specified on the Gift Voucher.
  13. The Gift Voucher will only be awarded if a winning school is willing to accept the Gift Voucher. In the event that a winning school expresses to the Promoter or Vibe Village that they do not wish to accept the Gift Voucher, the Gift Voucher will be awarded to the next highest scoring participating school and the original winning school will forfeit the Gift Voucher and will not be eligible to receive any prize or compensation in lieu.
  14. In the event of a tie for a Gift Voucher prize, the tied schools will be required to tell the Promoter and Vibe Village, in 25 words or less, why they deserve the Gift Voucher. The school that is the most deserving, as determined by Vibe Village and the Promoter, in their absolute discretion, will be awarded the Gift Voucher.
  15. The Gift Voucher will be awarded to the principal of each winning school.
  16. The Promoter's and Vibe Village's decision in relation to any aspect of this promotion, including the selection of any winning school and the final amount donated to The Smith Family's Healthy Eating Programs, is final and binding on every person who enters. No correspondence will be entered into.
  17. If for any reason a winning school does not take the Gift Voucher or an element of the Gift Voucher by the time stipulated by the Promoter or Vibe Village, then the Gift Voucher or that element of the Gift Voucher will be forfeited.
  18. If the Gift Voucher is unavailable, the Promoter and Vibe Village, in their discretion, reserve the right to substitute the Gift Voucher with another prize to the equal value and/or specification.
  19. Gift Voucher prizes, or any unused portion of a Gift Voucher prize, are not transferable or exchangeable and cannot be taken as cash.
  20. Participants consent to the Promoter and/or Vibe Village using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter and/or Vibe Village.
  21. The Promoter and Vibe Village may, in their absolute discretion, modify, suspend, cancel or recommence the promotion, as appropriate, if:
    1. for any reason, the promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter or Vibe Village which corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion; or
    2. the entry process, the determination of the prize winners and/or the delivery of the prizes is prevented or hindered by any outside agent or event including but not limited to vandalism, power failure, tempest, natural disaster, acts of God, civil unrest or strikes or other industrial action.
  22. Any cost associated with accessing the promotional website is the participant's responsibility and is dependent on the Internet service provider used.
  23. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter or nominate a participating school repeatedly is prohibited and will render all entries submitted by that individual and any points allocated in relation to that entry invalid.
  24. The Promoter and/or Vibe Village reserve the right to disqualify any participant (or cancel any points allocated to a participating school, as a result of that participant's entry) if a participant engages in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter and/or Vibe Village.
  25. Except for any liability that cannot be excluded by law, the Promoter and Vibe Village (including their officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's or Vibe Village's control); (b) any theft, unauthorised access or third party interference; (c) any entry, points allocation or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter or Vibe Village) due to any reason beyond the reasonable control of the Promoter or Vibe Village; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winning school or entrant; or (f) use of the prize.
  26. The Promoter and Vibe Village collect personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter and Vibe Village may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the participant. Participants should direct any request to access, update or correct information to Vibe Village. All entries become the property of the Promoter and Vibe Village.
